Due to the responsibility of shippers, freight forwarders and loaders to ensure that the correct travel permits are used

During inspections, the Lithuanian Transport Safety Administration (hereinafter - LTSA) together with the Customs of the Republic of Lithuania (hereinafter - Customs) increasingly identify cases when carriers registered in third countries transport goods loaded in the Republic of Lithuania without a proper travel permit or without properly completing it. If such violations are detected, the vehicle is prohibited from continuing to drive until the violation is eliminated, and the driver is subject to an administrative offense.
We remind you that for cargo transportation from the Republic of Lithuania, when such transportation is intended to be carried out by a third-party carrier (i.e. a carrier not established in a member state of the European Union), a travel permit of the Republic of Lithuania is required, regardless of the place of cargo unloading.
The consignor, freight forwarder or loader must make sure that the driver of the third-party carrier in the vehicle has a valid travel permit for the transportation of the cargo (Road Transport Code, Article 32, Part 3). In view of this, the order should be submitted to the third-party carrier and the cargo transportation contract should be concluded, then the cargo is loaded onto (on) the vehicle and it is released for driving only after the third-party carrier proves it and its driver actually has a travel permit corresponding to the nature of the cargo transportation. in the tool.
Please note that if it becomes clear during the inspections that the cargo is being transported without a proper permit or with an improperly completed permit, the administrative responsibility applies not only to the driver.
Administrative proceedings are also initiated against shippers, freight forwarders and loaders due to the performance of proper duties and a fine from 560 to 900 euros can be imposed, and for repeated cases - from 900 to 1500 euros (Article 450, paragraphs 9-10 of the Code of Administrative Offenses) .
In view of this, LTSA together with Customs asks you to ensure the proper performance of the established duties and to share this information with your members who have to perform the duties of shipper, forwarder or loader in their activities.
